Terms of Service

1Agreement to these Terms

ChartDeck (the website at chartdeck.trade, the charting terminal and every related page, email and API, together the "Service") is operated by Market Experts Trading LLC ("Company", "we", "us" or "our"). By accessing or using the Service you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2The service

ChartDeck is a multi-chart crypto charting terminal. It lets you view price charts from several cryptocurrency exchanges side by side, draw on charts, save layouts and watchlists, and use analytics views (such as Sectors and Trend) depending on your plan.

• ChartDeck is not a broker, exchange, custodian or investment adviser. We do not hold your funds or assets, and we do not route, place or execute orders.
• A "Trade" feature is shown in the terminal as coming soon. It is not available today. If we launch trading features later, they may come with additional terms that you will need to accept before using them.
• Some features (for example alerts or bar replay) may be marked as coming soon or be in preview; they may change or be withdrawn.

3Not financial advice; risk warning

• ChartDeck is a charting and information tool. Nothing in the Service (charts, indicators, analytics views, sectors, trend readings, alerts, emails or any other content) is investment, financial, legal or tax advice, or a recommendation to buy, sell or hold any asset.
• We do not owe you any fiduciary duty, and no adviser-client relationship is created by your use of the Service.
• Past performance is not indicative of future results. You may lose some or all of your capital.
• You are solely responsible for your trading decisions. We are not responsible for any trading losses you may incur.
• Always do your own research, and consider seeking independent professional advice before making any investment decision.

4Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you:

• are at least 18 years of age;
• have the legal capacity to enter into these Terms;
• are not prohibited from using the Service under applicable law; and
• will comply with all applicable laws and regulations, including those that apply to crypto-asset trading where you live.

5Accounts and sign-in

You can use parts of ChartDeck without an account. To save your work or use a paid plan you need an account. You can sign in with an email address and password, with a supported social provider (such as Google, Discord, Apple, X or Telegram, as offered on the sign-in page), or by signing a one-time message with a crypto wallet (such as MetaMask, Phantom or Trust Wallet). Signing in with a wallet never creates a transaction or costs a fee.

When you create or use an account, you agree to:

• provide accurate, current and complete information, and keep it up to date;
• keep your password, sign-in providers and wallets secure;
• accept responsibility for all activity under your account;
• use one account per person, and not share your account or sign-in with anyone else; and
• notify us immediately at [email protected] of any unauthorized use of your account.

Your use of a social sign-in provider or wallet is also subject to that provider's own terms. We reserve the right to suspend or terminate accounts that violate these Terms.

6Plans, billing and renewal

ChartDeck offers the following plans. All prices are in US dollars (USD) unless otherwise stated, and do not include any taxes, bank or network fees you may be charged.

What each plan includes (for example the number of live markets and chart panes, and access to analytics views) is described on the pricing page. We may change plan features and prices; a price change will not affect a period you have already paid for, and we will tell you before a change applies to your next renewal.

Card payments (Stripe)

• Card payments are processed by Stripe. You can pay monthly or yearly.
• Card plans are subscriptions that renew automatically at the end of each billing period, at the then-current price, until you cancel. By subscribing, you authorize us (through Stripe) to charge your payment method for each renewal.
• You can cancel at any time from the Plan & billing section of your account (which opens the Stripe billing portal). Cancellation takes effect at the end of the current billing period; you keep access until then and are not charged again.

Crypto payments (BTCPay and wallets)

• You can pay with Bitcoin through our BTCPay server, or with supported stablecoins from a wallet such as MetaMask, Phantom or Trust Wallet.
• Crypto payments are available for yearly plans only. Each payment buys 365 days of the plan from the time it is confirmed (or from the end of your current paid period, if you extend early).
• Crypto payments are one-time and do not renew automatically. When the 365 days end, your account returns to the Beginner plan unless you pay again.
• You are responsible for sending the exact amount, on the network and in the asset shown on the payment screen, before the payment request expires. On-chain transfers cannot be reversed by us; network fees are yours. A payment sent to the wrong address, network or asset may be lost.

7Cancellation and refunds

Refunds are provided in accordance with our Refund Policy. In short: refund requests must be made within 3 calendar days of the charge; cancelling stops future renewals but does not refund the current period; and no partial refunds are given for unused time.

8Market data from third parties

Prices, candles, volumes, order-flow data, market lists and similar information in ChartDeck come from third-party exchanges and venues, including Binance, Bybit, OKX, Bitget, BloFin, Hyperliquid, MEXC, Gate, KuCoin and Coinbase. We are not affiliated with, endorsed by or responsible for these venues.

• Market data is provided "as is". It may be delayed, incomplete, interrupted or inaccurate, and a venue may change or stop providing it at any time.
• Analytics views, indicators and other figures we compute from that data inherit its limitations.
• Always confirm prices on the venue itself before you trade. Do not rely on ChartDeck as your only source of price information.

9Your content

You keep ownership of what you create or upload in ChartDeck, such as chart drawings, layouts, watchlists, alerts, preferences, your display name and your profile picture ("Your Content").

• You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and display Your Content only as needed to run the Service for you (for example, to sync your drawings across devices).
• You are responsible for Your Content. Do not upload anything unlawful, infringing, offensive, or that you do not have the right to use.
• We may remove content that breaks these Terms. We do not guarantee that Your Content will be preserved; keep your own copy of anything important.

10Acceptable use

You agree not to:

• use the Service for any illegal purpose, or for market manipulation or fraudulent trading activity;
• scrape, bulk-download, cache, resell, redistribute or republish market data, analytics or other content from the Service, or use it to build a competing product or data feed;
• use bots, scripts or other automated means to access the Service, except through features we provide for that purpose;
• overload, probe, disrupt or interfere with the Service or its infrastructure, including by opening excessive connections or circumventing rate limits or plan limits;
• attempt to gain unauthorized access to our systems or to other users' accounts;
• share, sell or transfer your account or sign-in, or let others use a paid plan through your account;
• reverse engineer or attempt to extract the source code of our software, except where the law allows it; or
• harass, abuse or harm other users.

11Intellectual property

All content, features and functionality of the Service, including but not limited to text, graphics, logos, icons, images, data compilations, software, and the compilation thereof, are the exclusive property of Market Experts Trading LLC or its licensors and are protected by copyright, trademark and other intellectual property laws. Market data remains the property of the venues that provide it.

You may not copy, modify or distribute our content without permission, or use the ChartDeck or Market Experts names, logos or branding without our written authorization. You may share screenshots of your own charts for personal, non-commercial purposes.

12Third-party services

The Service relies on or links to third-party services, including exchanges and data venues, payment processors (Stripe and our BTCPay server), crypto wallets, social sign-in providers, and Cloudflare (including its Turnstile bot check). Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their content.

13Changes to the service

We are continuously improving ChartDeck. We may add, change or remove features, venues or markets, and we may interrupt the Service for maintenance or for reasons outside our control. We will try to give reasonable notice of changes that materially reduce a paid plan.

14Suspension and termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us or third parties, or for any other reason. Accounts suspended or terminated for violating these Terms are not entitled to a refund.

You may stop using the Service at any time. To close your account and delete your data, email [email protected]. Sections that by their nature should survive termination (including 3, 8, 11 and 15 to 18) survive.

15Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• merchantability and fitness for a particular purpose;
• the accuracy, completeness, timeliness or reliability of any market data or other information;
• uninterrupted, secure or error-free service; and
• any results from trading or other decisions based on the Service.

16Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKET EXPERTS TRADING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• loss of profits, data or goodwill;
• trading losses or missed opportunities, including losses caused by delayed, missing or inaccurate market data;
• service interruptions or data breaches; and
• any damages resulting from your reliance on the Service or its content.

Our total liability shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the claim.

17Indemnification

You agree to indemnify, defend and hold harmless Market Experts Trading LLC, its officers, directors, employees and agents from any claims, damages, losses, liabilities and expenses (including attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.

18Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

19Changes to these Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date, and, for material changes, by email or in the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
